(A) The following minimum requirements for facilities and services apply to all franchises. Subject to the requirements of federal law, the city may require that a franchise exceed these minimum requirements.
(1) A cable system constructed or rebuilt after the effective date of this chapter must have a minimum capacity of 54 video channels available for immediate or potential use and have the capability for two-way communications.
(2) A cable system may be required to provide one or more access channels for public, educational or governmental access or reserve channels for future access use.
(3) A cable system must provide leased access channels as required by federal law.
(4) Service to buildings utilized exclusively by the city and that are passed by existing cable plant may be required without charge as set forth in the franchise agreement.
(5) A cable system must serve all areas of the city with a housing density of at least 25 dwellings per cable mile.
(B) Subject to the provisions of § 115.17(C), the city may waive minimum requirements of this section where, in the judgment of the city, the waiver is justified in the public interest.
