For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
TEMPORARY OR TRANSIENT BUSINESS. Any business conducted for the sale or offer for sale of goods, wares or merchandise which is carried on in any building, structure, motor vehicle or real estate in one locality for a period of less than six continuous uninterrupted months in each year and which employs no more than 50 persons at any one time as part of its business operations.
TRANSIENT MERCHANT. Any person, which shall include a sole proprietorship, but which shall not include any business organization such as a partnership, limited liability company, corporation, or any other recognized legal entity, which engages in, does or transacts any temporary or transient business in the city, either in one locality or in traveling from place to place in the city offering for sale or selling goods, wares, merchandise or commodities of any kind, and includes those merchants who, for the purpose of carrying on the business, hire, lease, use or occupy any building, structure, motor vehicle or real estate.
