§ 98.06 FEES.
   (A)   Fees to be paid by the owner of any entity at which a hazardous materials incident occurs shall be as follows:

   (B)   Replacement costs of any materials, equipment, supplies or other items or personnel or services not specifically described in this section shall be assessed on the basis of actual costs, to a subscriber, and one and one-half X actual costs to a non-subscriber.
   (C)   A non-subscriber shall, in addition to all other costs described herein to be paid in the event of a hazardous materials incident response by the Fire Department, be assessed a $20,000 response fee for any emergency hazardous substance response, and a $10,000 fee for any non-emergency hazardous response.
   (D)   All fees, expenses and assessments billed to a spiller, or to an entity requesting a response, shall be paid within 30 days of the date of the billing. Bills remaining unpaid after 30 days shall constitute a lien upon the property of the spiller, in the event the spill occurred on property of the spiller.
   (E)   Subscribers to the original hazardous materials response plan who paid the aggregate sum of $45,000 to the city by August 1, 1999, shall pay fees at the “subscriber” rate for response to a spill. If the sum was not paid by that date, then the original subscribers shall pay fees at the “non-subscriber” rate.
