(A) The Mayor is authorized to enter into agreements with industries, or other entities in the city, desirous of becoming subscribers to the hazardous materials response plan, whereby in exchange for the payment of a lump sum advance fee, no fees will be charged by the city to the entity for the services of the Fire Department in responding to a hazardous materials incident, except as otherwise provided herein, and provided further that the exemption from fees shall not extend to the expenses incident to the disposition of any hazardous waste materials, but rather shall apply only to on-site activities of the Fire Department.
(B) The hazardous materials response plan shall not be implemented until agreements have been signed with entities and fee payments received in the minimum amount of $90,000.
