§ 51.195 EFFECTIVE DATE; EXTENSIONS FOR EXISTING VIOLATIONS.
   This chapter shall be in full force and effect 60 days from and after the date of its passage as provided by law; however, any present customer then in violation of §§ 51.105 through 51.109 and §§ 51.121 through 51.124 may be given exception for time to provide pretreatment if the following conditions are met:
   (A)   The violator requests exception with plan and time schedule for plans, specifications and completion of construction of pretreatment facilities to ensure compliance with this chapter;
   (B)   The Water and Sewer Commission may then grant exception to penalties and surcharges if the time schedule is reasonable and work progresses on schedule;
   (C)   The Water and Sewer Commission may continue to surcharge (for heavy organic loadings) at rates sufficient to recover additional costs associated with higher loadings; and
   (D)   The exception in no way affects the safety and welfare of any receiving stream, person or treatment works.
