§ 31.46 CITY ADMINISTRATIVE OFFICER.
   (A)   Established. The non-elected city office of City Administrative Officer is hereby established.
   (B)   Appointment and removal. The Mayor, with the approval of the City Council, shall appoint the City Administrative Officer who shall be directly responsible to the executive authority of the city. The Mayor may remove the City Administrative Officer, at will, except as otherwise provided by statute or ordinance.
   (C)   Qualifications. The City Administrative Officer shall have, at a minimum, the following qualifications:
      (1)   Be a high school graduate;
      (2)   Have five years' experience in county or municipal government, or in lieu thereof, a college degree in business administration; and
      (3)   Possess sufficient skills and/or vocational certifications or training that, in the executive authority’s sole discretion, will enable the individual to perform the duties and responsibilities set forth below.
   (D)   Duties and responsibilities. The duties and responsibilities of City Administrative Officer shall include, but not be limited to, the following:
      (1)   Advise the executive authority of the city in policy formulation on overall problems of the city;
      (2)   Preparation and administration of operating and capital improvement budgets under direction of the executive authority;
      (3)   Advise the executive authority of the city in the appointment of subordinate administrative personnel if not delegated appointment authority by appropriate order;
      (4)   Have continuing direct relationships with operating department heads on implementation and administration of programs; and
      (5)   Subject to the executive authority’s direction and ultimate authority, supervise, coordinate, and oversee the executive authority's office staff.
   (E)   Delegated duties. The City Administrative Officer shall carry out all additional duties lawfully delegated by appropriate order of the executive authority and shall have the same powers as the executive authority in carrying out such duties.
   (F)   Oath and bond. No person shall be appointed as City Administrative Officer unless that person has taken the oath required by § 228 of the Constitution of the Commonwealth of Kentucky, and has provided a bond in the sum as established by City Council, with corporate surety authorized to transact business in the Commonwealth of Kentucky, and conditioned upon the performance of the duties specified.
   (G)   Compensation. The compensation of the City Administrative Officer shall be established by the executive authority of the city in accordance with the personnel and pay classification plan of the city.
