§ 110.15 CIGARETTE LICENSE.
   (A)   Coverage. Every person, pursuant to Wis. Stats. § 134.65 and this chapter, who sells in the village cigarettes to a person who does not hold a village cigarette license or who does not hold a permit under Wis. Stats. §§ 139.30 to 139.41 or 139.79, shall seek and obtain a cigarette sales license from the village. The fee for such license shall be, by statute, per premises at an amount which can be located in the office of the Village Clerk. The license shall be issued from July 1 of one year to June 30 of the next year. The license shall be issued by the Village Clerk prior to any person selling any cigarettes without the proper license or permit in the village.
   (B)   Application/license. The applications and license shall designate the premises. Such licenses are not transferable from one person to another or are not to be amended from one premises to another. The application shall include:
      (1)   The name of the applicant;
      (2)   The address of the applicant;
      (3)   The address of the premises;
      (4)   The business and residential telephone number of the applicant, if any; and
      (5)   The age of the applicant.
   (C)   Ordinance/license.
      (1)   Persons subject to this section shall comply with Wis. Stats. § 134.65 and this chapter.
      (2)   The Village Clerk shall provide copies of this section at no cost to any applicant requesting copies under this chapter.
      (3)   The applicant and any other person subject to this chapter shall comply as follows.
         (a)   No person shall be issued or reissued a cigarette retail sales license in the village until the appropriate fee has been paid to the Village Clerk.
         (b)   No person shall be issued or reissued a cigarette retail sales license in the village who has failed to properly and fully complete and submit to the Village Clerk the application form as developed and provided by the village.
         (c)   No person shall be issued or reissued a cigarette retail sales license until the person owns or has leased a premises in the village.
      (4)   No person shall cause, allow or permit any person to sell or provide in the village cigarette or tobacco products to a person under the age of 18 years. This provision shall be subject to any defenses for persons established under Wis. Stats. § 134.66. No person shall cause, allow or permit any cigarette vending machine in the village within 500 feet of a school. “School”, for the purpose of this section, has the meaning given in Wis. Stats. § 118.257(1)(d).
