(A) Trees, plants and/or shrubs planted without a permit within any boulevard or planting easement after the date of this chapter may be removed. The Village Forester shall notify the abutting property owner in writing, listing the unlawfully planted trees, plants and/or shrubs, ordering their removal, and establishing a reasonable time within which such removal shall be accomplished. In the event removal is not accomplished within the time specified, the village may remove such trees, plants and/or shrubs and may assess the entire costs to the abutting property owner.
(B) Items to follow if an abutting property owner receives a tree planting permit are the following.
(1) No tree shall be planted which is less than one and one-half inches in caliper measured six inches above the ground.
(2) No tree shall be planted closer than two feet from either the street curb or edge of the sidewalk.
(3) No tree shall be planted in a boulevard that has a total width of less than five feet.
(4) No shade type tree (oaks, maples, basswood, elms and the like) or trees that will have a mature height of 30 feet or more may be planted in boulevards that have overhead utility lines.
(5) No tree shall be planted less than ten feet from any driveway or fire hydrant, 20 feet from a street sign or within the designated clear vision triangle at an intersection.
(6) Street tree spacing shall be a minimum of 30 feet apart for small sized trees, i.e., crabapples, hawthorns, Japanese tree lilacs, with 45 to 50 feet being preferred for shade trees, i.e., basswood, maple, oaks, elms and the like. The following trees shall not be planted on the village’s boulevards: any conifers, any species of the genus populus, box elder, any willow, silver, Norway maple or black locust.
