§ 91.06 ABATEMENT OF TREE NUISANCES.
   (A)   Tree disease a public nuisance. The Village Board has determined there are many trees growing on public or private premises within the village, the loss of which could depreciate the value of the urban forest, impair the use and enjoyment of public and private property, and that the health and life of such trees could be threatened by fatal diseases, insects or risk trees (dead, damaged, split trunk, hanging limbs and the like). The Village Board hereby declares its intention to control and prevent these situations for the health of trees, and general welfare of citizens’ property and lives (incorporated in Chapter 94).
   (B)   Inspection. The Village Forester may, under § 91.04, inspect or cause to be inspected all premises and places within the village to determine whether any tree nuisance exists.
   (C)   Abatement procedures. When the Village Forester determines with reasonable certainty that a tree nuisance exists and becomes dangerous or obstructive upon private premises, he or she shall immediately report the same to the Police Department for process under Chapter 94.
