§ 38.17 RESOLUTION OF SOLICITATION AND CONTRACT AWARD PROTESTS.
   (A)   The Town Manager has the authority to resolve a protest.
   (B)   The Town Manager shall issue a written decision within 14 days after a protest has been filed as set forth hereinbefore. The decision of the Town Manager shall contain the basis for the decision and a statement that the decision may be appealed to the Town Council within 30 days from receipt of the decision.
   (C)   The Town Manager shall furnish the decision to the interested party, by certified mail, return receipt requested, or by any other means that provides evidence of receipt.
   (D)   If the Town Manager fails to issue a decision with the time limits set forth hereinbefore, the interested party may proceed as if the Town Manager had issued an adverse decision.
