(A) No person shall be in a public place or a town public recreation area or park while under the excess influence of alcohol, toxic vapors, poisons, narcotics or any other illegal drug not therapeutically administered, and it reasonably appears that he (she) may either endanger himself or herself, or other persons or property.
(B) In addition to any other penalties imposed as set forth hereinbefore, a person convicted of this section shall be required to complete a court ordered alcohol or other drug screening, education or treatment program.
(C) A second conviction of this section shall be deemed to be a class one misdemeanor, subject to the penalty provisions of the Arizona Revised Statutes.
