(A) Upon application to the town, a historic site or a historic district may be created only by ordinance adopted by the Town Council. The application shall be reviewed by staff for accuracy, sufficiency, and compliance with land use regulations. A public hearing on the application shall be held by the Historic Preservation Commission. Staff and the Historic Preservation Commission shall forward a report and recommendations on the application to the Town Council.
(B) The Mayor and Council shall consider whether to designate by ordinance a building, structure or object as a historic site or an area as a historic district upon the recommendation of the Historic Preservation Commission. The Commission shall consider either designation upon the direction of the Mayor and Council or upon the application of 35 or more adult residents of the town filed in the office of the Planning and Zoning Division.
(C) A fee of an amount as set from time to time by resolution of the Town Council shall be required for the filing of an application for either designation. The form of the application shall be determined by the Commission and made available to the public at the office of the Planning and Zoning Division.
