§ 93.12 UNLAWFUL ACTS.
   It is unlawful for any person to:
   (A)   Place or cause to be placed any refuse upon any public or private property not owned or under his or her control;
   (B)   Place or cause to be placed any unwrapped putrescible waste in any refuse container, unless all liquid shall have been drained therefrom;
   (C)   Place or cause to be placed more than a limited amount of filth in a refuse container; limits to be set by the Director or Public Works or his agent;
   (D)   Place or cause to be placed any unwrapped filth in any refuse container, unless the container is used only for that purpose;
   (E)   Place or cause to be placed any unwrapped, small, dead animal in a refuse container;
   (F)   Fail to make arrangements for the removal of construction waste within 30 days after it is generated, but in no case before:
      (1)   Final building inspection;
      (2)   Clearance of public utilities; and/or
      (3)   Issuance of a certificate of occupancy,
   (G)   Place or cause to be placed refuse in a container not owned or maintained by him or her;
   (H)   Burn or cause to be burned any refuse without the written permission of the town and the Fire Chief;
   (I)   No person shall cast or cause to be cast, place, sweep, or deposit anywhere within the town any solid waste in such a manner that it may be carried or deposited by the elements or animals upon any street, sidewalk, alley, sewer, parkway, or other public place, or into any occupied premises within the town;
   (J)   It shall be unlawful for any person to uncover or cause to be uncovered, tip or cause to be tipped over, or disturb or cause to be disturbed in any manner any container of solid waste or recyclables placed upon any street, curb, sidewalk, or alley for removal by an authorized collector;
   (K)   Vandalism or graffiti of containers is unlawful, and shall be reported to the Sanitation Division by the solid waste customer;
   (L)   No solid waste or materials other than recyclables shall be placed or stored in any container provided for the storage and collection of recyclables;
   (M)   Permit or cause, willfully or negligently, the escape or flow of water in a quantity as to result in the flooding, and impeding of vehicular or pedestrian traffic, thereby causing damage to public rights-of-way, private premises not owned by the person responsible for the generation, and creating a hazard to the traffic and a threat to the public health, safety, and welfare;
   (N)   Fail to restrain any vicious animal or prevent interference with collection employees or contractors acting in the course of their employment;
   (O)   Close or obstruct any right-of-way, impeding the normal operation of the Department of Sanitation, Public Works Department, Fire Department or any police agency, unless a special permit has been granted by the town, Director of Public Works, Fire Chief, or police agency at least three days prior to closing the right of way;
   (P)   Close or obstruct an alley for more than 24 consecutive hours, unless the closing is for the purpose of making sewer, gas, or water utility installations; and
   (Q)   Remove, haul, or cause to be removed any refuse on or along any town right-of-way, street, or alley, unless the same is contained in watertight containers so constructed as to prevent any refuse from falling, leaking, or spilling therefrom. All loads shall be securely anchored and must be properly covered.
   (R)   No person, other than the town, the property owner, or a company licensed for collection, shall disturb, collect, or remove any solid waste set for collection or placed by a resident in the residential refuse collection and recycling center. Further, no person, unless authorized by the town, may remove, collect, or disturb recyclable materials deposited for collection town containers.
   (S)   No person shall place or cause to be placed any bio-hazardous medical waste in any refuse or recycling container unless it is in a specifically designated bag or container used exclusively for that purpose.
