§ 90.05 DEPOSITS.
   No permit shall be issued unless and until the applicant has deposited with the Clerk a cash deposit in the sum of $100 if no pavement is involved and $500 if the excavation is in a paved area to ensure the proper restoration of the ground and the laying of the pavement, if any. If the person, firm or corporation doing the work covered by this deposit fails to comply with instructions on backfill and surfacing which will bring the area up to the same condition as before the work was started, the town shall take over the uncompleted work and from the money on deposit shall be deducted the expense of the town in having to restore the surface of the ground or the pavement. The balance of the deposit, if any, shall be returned to the applicant without interest after all work has been completed. Deposits may be held by the town for a period of not to exceed six months. Under certain conditions, where the town feels that the above deposit amounts are inadequate, the amounts may be increased.
