941.01 DEFINITIONS AND PARK HOURS.
   (a)    As used in Chapter 941 of the Codified Ordinances of the Village of Gibsonburg:
      (1)    "Administrator" means the Village Administrator or, in the Village Administrator's absence or during such periods of time when the Village Administrator cannot act, the Mayor.
      (2)    "Animal or Animals" means and includes, but is not limited to, quadrupeds, mammals, birds, fish, reptiles, amphibians, crustaceans, mollusks, and insects.
      (3)    "Balloon Launcher" or "Rocket Launcher" means a projectile launching device or a device designed to hold a tangible item in position for launching.
      (4)    "Camping" means the utilization of any piece of equipment for sleeping in or upon, including, but not limited to, a sleeping bag, hammock, station wagon, car, van, motor home, bus, trailer, tent, tarp, truck, house vehicle, pickup camper, or watercraft, for the purpose of occupying a portion of land or water for transient and temporary outdoor living.
      (5)    "Commercial Activity or Commercial Activities" means any activity undertaken as part of a commercial enterprise or profit-making venture.
      (6)    "Fish or Fishing" means taking or attempting to take fish by any method, and acts such as placing, setting, drawing, or using any device commonly used to fish, whether resulting in such taking or not.
      (7)    "Motor Vehicle or Motor Vehicles" means any vehicle propelled or drawn by power other than muscular power.
      (8)    "Officer or Officers" means any of the following:
         A.    A sheriff, deputy sheriff, constable, peace officer of a township or joint township police district, marshal, deputy marshal, municipal police officer, member of a police force employed by a metropolitan housing authority or State highway patrol trooper;
         B.    An officer, agent or employee of the State or any of its agencies, instrumentalities or political subdivisions, upon whom, by statute, Charter, or ordinance, a duty to conserve the peace or to enforce all or certain laws is imposed and the authority to arrest violators is conferred, within the limits of that statutory duty and authority;
      (9)    "Paint Ball Gun or Paint Ball Guns" means an air gun used to propel dye-filled gelatinous capsules.
      (10)    "Park or Parks" means any land or water area owned, leased, or otherwise controlled by the Village of Gibsonburg, Ohio for recreational open space or similar and related purposes.
      (11)   "Park Facility or Park Facilities" means any structure, building, or area owned, leased, or otherwise controlled by the Village of Gibsonburg, Ohio for recreational or similar and related purposes.
      (12)    "Park Waters" means any lake, pond, reservoir, stream, pool, channel, lagoon, drainage ditch, or other body of water, or any part thereof, whether natural or artificial, located in an adjoining Park.
      (13)    "Person or Persons" means any individual, company, partnership, corporation, association, or any combination of individuals, employees, agents, or officers thereof.
      (14)    "Regular Park Hours" means from 6:00 a.m. to 11:00 p.m. Eastern Standard Time year round.
      (15)    "Vehicle or Vehicles" means every conveyance with wheels, treads, or other means of locomotion.
      (16)    "Village" means the Village of Gibsonburg, Ohio.
      (17)    "Under Speed Vehicle" means a vehicle that either is originally designed and constructed with a top attainable speed of 20 miles per hour or less, or is not originally designed and constructed for operation on a street or highway.
   (b)    Park Hours.
      (1)    Each Park in the Village ordinarily shall be open during Regular Park Hours, as defined in subsection (a)(11) of this section.
      (2)    No Person shall enter or remain in any area of a Park during times that are not set as Regular Park Hours, unless written permission is first obtained from the Administrator for such purposes that, from time to time, are deemed by the Administrator to be in the best interest of the Village.
      (3)    The Village Chief of Police, local fire official, or the Administrator may temporarily close Parks to public use or evacuate a facility or area in a Park that is determined to be hazardous for public use due to weather, water, fire, construction, or other situations involving public health, safety, or welfare.
