901.08 DRIVEWAY EXCAVATIONS.
   (a)    No owner or occupier of property abutting upon the public streets within the Village shall construct an entrance to a private drive nor cut any existing curbing within the public streets before applying to Council for permission to do so, and no such work shall be commenced until after permission has been so obtained.
 
   (b)    Such work, when permitted, shall not interfere with the primary use of the street for the purposes of public travel and shall not damage nor adversely affect the existing street or the drainage thereof.
 
   (c)    Such work, when in progress, shall meet with the approval of the Village Administrator or his designee who shall be the duly authorized agent of Council.
 
   (d)   No interference with the drainage of the streets shall be caused by any owner or occupier of property abutting upon such public streets in any manner whatever.
 
   (e)   For the first violation of this section or any of its provisions the penalty shall be the removal or rectification of such violation at the expense of the abutting property owner or occupier; and that a second or subsequent violation of the provisions of this section or any part thereof shall subject the abutting property owner or occupier committing the violation to a fine of fifty dollars ($50.00) upon conviction thereof, which fine shall be in addition to the penalties provided for a first offense.
