(a) The Village Administrator, Police Chief, Tax Commissioner, and Solicitor, are salaried employees and not entitled to overtime pay. All other employees are hourly employees. All elected officials are not considered employees. All other full time hourly employees are entitled to overtime pay.
(b) The work week for all non-police employees (service employees) shall be established as Monday to Sunday of each week.
(c) The work week for all Village police employees shall be established as Sunday to Saturday of each week.
(d) That police employees shall be paid overtime for any period actually worked, which exceeds forty hours in any one work week.
(e) That non-police employees (service employees) shall be paid overtime for actual or on call work hours actually worked which exceed forty hours per week. On call time or off duty hour call in time shall be counted towards the hours actually worked in computing overtime pay for service employees.
(f) Vacation time, sick leave, personal leave, or any other time period where the employee is not actually working for the Village will not be included in the calculation of the minimum hours per week necessary to qualify for overtime pay. Holidays shall be included in the calculation of the minimum hours per week necessary to qualify for overtime pay. Minimum hours shall be “service employees” forty hours and “police employees” forty hours per week.
(g) Any hourly employee who works more than the regular work week (service employees forty hours, police employees forty hours) shall be paid overtime compensation at a rate of one and one-half their normal hourly rate of pay. (Ord. 16-2002. Passed 12-19-02.)
