(a) The following Park Facilities are available for reservation by residents eighteen (18) years of age or older for exclusive resident and non-resident use:
(1) Baseball/softball fields, volleyball courts, and all other sporting fields or courts;
(2) Shelter houses;
(3) Fishing platforms;
(4) The Veteran's Memorial; and
(5) The Cancer Remembrance area.
(b) Organized sporting leagues may reserve any softball field, baseball field, volleyball court, or other sporting field or court for a seasonable period through a league representative who is a resident of the Village. All residents may reserve any Park Facility for a one (1) day period not to exceed Regular Park Hours.
(c) A twenty-five dollar ($25.00) non-refundable fee shall be paid to the Village to reserve the exclusive use of a shelter house within a Park. The right to establish a further fee schedule for the reservation of Park Facilities is expressly provided herein. All fees collected for any Park reservation shall be deposited to the General Fund.
(d) Upon the request of a reservation by a Village resident, the Administrator shall grant a permit for the reservation of the requested Park Facility, date, and times on the condition that:
(1) The Administrator receives a completed reservation request form, which is available in the Administrator's office in the Village Hall during Village business hours, at least fourteen (14) days in advance of the requested starting time of the reservation period;
(2) The resident requesting the Park Facility provides proof of liability insurance at least fourteen (14) days in advance of the requested starting time of the reservation period.
(3) Any applicable reservation fee is paid at least fourteen (14) days in advance of the requested starting time of the reservation period;
(4) The Park Facility requested is not previously reserved for that date, location, and time by another resident or sporting league;
(5) The Park or portion thereof requested is not necessary for a Parks and Recreation Department function;
(6) The use complies with all Federal, State, and local laws, regulations, and rules; and
(7) The resident requesting the reservation has not been previously found by a Court of competent jurisdiction to have abused any Park Facilities or ground or to have violated any local, state, or federal law while on Park property.
(e) A Park Facility shall be deemed reserved once the Administrator grants a permit for reservation.
(f) A permit holder shall be granted the exclusive use of the Park Facility or area thereof specified in the issued permit for such time and specific location stated on the permit. The exclusive right to the designated area expires on the date and time stated on the issued permit. All permits issued are non-transferable and must be in the permit holder's possession on the grounds during the reservation period to be granted exclusive use. A permit holder shall not exclude anyone from entering any other area of a Park not specified in the permit holder's permit during Regular Park Hours.
(g) All Persons participating in an organized sporting league shall sign a Waiver of Liability available at the Administrator's office before any such member may use Park Facilities in connection with an organized sporting league.
(h) All participating organized sporting league members shall be responsible for maintaining the field or court during said reservation period.
