(a) The Village Manager is hereby directed to establish a no smoking policy for all Municipally owned structures and vehicles.
(b) The Village Manager is hereby authorized to amend such no smoking policy as he deems appropriate and necessary.

No Smoking Policy
This smoking policy is designed to foster the health and safety of all Village of Germantown employees and its citizens. It is also intended to protect Village resources and promote efficiency. To that end, this policy prohibits smoking in all Village facilities and vehicles.
Smoking poses a significant risk to the health of the smoker. It can damage sensitive technical equipment and can be a safety hazard. Nonsmokers with chronic heart or lung disease can experience severe distress when exposed to sufficient concentrations of second-hand smoke. Many allergic individuals and the majority of healthy nonsmokers report discomfort when exposed to second-hand smoke on the job. The U.S. Surgeon General has determined that involuntary smoking is a cause of disease, including lung cancer, in healthy nonsmokers.
The citizens of Germantown have the right to enter the Municipal Building without being exposed to smoke. Because the current set up of the building is such that all areas are open to public visitation, no areas will be exempt from the smoking policy. Separate areas for smoking cannot be made available. Additionally, all areas of the building contain sensitive equipment and files which could be damaged or destroyed by fire, ashes and smoke. This policy shall extend to include any areas where combustible fumes can collect, areas where chemicals are used and all other designated areas where an occupational hazard might exist.
This policy shall be in effect (1) month after the effective date of Ordinance 93-01. The Village shall provide at the cost of the Municipality, a smoking cessation program through Western Ohio Health Care and Good Samaritan Hospital. Interested employees should contact the Manager's office immediately.
Employees that violate the no smoking policy will be subject to appropriate disciplinary measures.
Visitors or guests in Municipal facilities or vehicles shall be requested to refrain from smoking or to leave the premises.
