(a) Smoking has been declared by the state legislature, pursuant to Ohio R.C. Chapter 3794, to be a statewide concern and therefore it is in the best interests of public health that smoking be prohibited and/or restricted, with some exceptions, on propetiy owned or under the control of the City.
(b) Pursuant to Ohio Revised Code section 3794.05, the City hereby declares any public outdoor place, as defined herein, which is owned and/or controlled by the City and which does not otherwise qualify as a non-smoking place under Ohio Revised Code Chapter 3794, to be a non-smoking place.
