121.01 SUNSHINE RULE; REGULAR AND SPECIAL MEETINGS.
   (a)    Regular Council Meetings. Regular meetings of Council shall be held on the first and third Monday of each month at 7:00 p. m. provided that if such day is a legal holiday under the laws of Ohio then the regular meeting of Council shall be held on the next succeeding day which is not a legal holiday. Council may authorize additional regular meetings by a majority vote, and may change the frequency and dates of regular meetings as provided in this section by a three-fourths vote of all members of Council.
   A majority of the members of Council shall constitute a quorum for the transaction of business at any meeting of Council but a lesser number may adjourn the meeting from time to time and compel, by a majority vote of the members present, the attendance of absent members in such manner and under such penalties as may be prescribed by ordinance. The Clerk of Council shall keep a record of Council's proceedings in a journal or other record as determined by Council in which the vote on any ordinance, resolution or other measure shall be recorded. All meetings of the Council shall be open to the public and each journal and other records of the Council shall be available for public inspection at all reasonable times. Such meetings shall be held at such times and places as shall be determined by Council.

   (b)    Special Council Meetings. Special meetings may be called by a vote of Council taken at any regular or special meeting thereof or may be called by the Mayor, or any three members of Council. The Clerk of Council, or in his absence, incapacity or refusal to act, the Mayor shall cause notice in writing of each special meeting to be served personally or to be left at the usual place of residence of each member of Council and the Mayor not less than twenty-four hours prior to such special meeting but failure to so post or to maintain posting for twenty-four hours shall not affect the validity of any meeting or any action taken at such meeting. In the event that a special meeting is called by a vote of Council taken at a regular or special meeting from which any member of Council or the Mayor is absent, written notice of such special meeting shall be given each absentee in the manner hereinbefore described. Service of notice of any special meeting shall be deemed conclusively to have been waived by any member of Council or the Mayor who shall be present at such special meeting.
   (c)    Notice to Media of Special Meetings. Council shall not hold special meetings unless it gives at least twenty-four hours advance notice to the news media that have requested notification except in the event of an emergency requiring immediate official action. In the event of an emergency, the member or members calling the meeting shall notify the news media that have requested notification immediately of the time, place and purpose of the meeting.
   (d)    Advance Notification. Any person may, upon request and payment of a reasonable fee to be established by the Clerk of Council obtain reasonable advance notification of all meetings at which any specific type of public business is to be discussed. The advance notification shall include those items which are provided to members of Council which may include but not limited to the mailing of the agenda, financial report, list of City vouchers, Manager's report and legislation and such other matters as the Clerk of Council may deem appropriate to all subscribers on a mailing list or mailing notices in self-addressed stamped envelopes provided by the person.
   (e)    Duties of Clerk of Council. The Clerk of Council shall have on file for public examination and purchase at a reasonable fee established by the Clerk the rule adopted pursuant to the Sunshine Law for the following public bodies of the City: Council; Planning Commission; Park and Recreation Board; Cemetery Board of Trustees; Board of Zoning Appeals; Board of Tax Appeals; Charter Commission; Bicentennial Commission; Volunteer Firemen's Dependents Fund Board; committees of Council; committees of the Mayor; Zoning Ordinance Review Committee and any other public body as defined by law.
   (f)    Posting. This rule shall be permanently posted in the Municipal Building in a prominent place.
