(a) No person, firm, partnership, association, corporation, company or organization of any kind shall engage in the business of hauling rubbish, refuse or garbage within the corporate limits of Germantown, without first obtaining a license from the Manager. The Manager shall issue such licenses to all applicants whose service and equipment meet the requirements of this chapter except that only one such license shall be granted for residential refuse collection.
(b) It is hereby declared to be in the best interests of the residents of Germantown not to issue more than one general license within the corporate limits of Germantown for the collection of residential refuse. Therefore the Manager is hereby authorized to issue only one general license which shall be considered an exclusive franchise. However, the Manager may issue a limited license for a restricted time and purpose for the collection of rubbish, refuse and garbage. The Manager is also authorized to adopt such rules, regulations and fees for the issuance of such limited license as may serve the best interests of the Municipality.
The exclusive franchise provided for herein shall be granted to the contractor as provided in this chapter.
(c) Prior to obtaining a solid waste collector's license the applicant shall show proof that each vehicle to be used is covered by liability insurance and that the necessary insurance is obtained as outlined herein. Commercial general liability for bodily and property damage in the amount of one million dollars ($1,000,000) combined single limit with one million dollars ($1,000,000) aggregate. Commercial automobile liability for bodily and property damage in the amount of one million dollars ($1,000,000) combined single limit with one million dollars ($1,000,000) aggregate.
