(A) The Town Department of Storm Water Management and Town Storm Water Board are hereby established.
(B) The provisions of I.C. 8-1.5-5 et seq. are hereby adopted and incorporated hereto by reference.
(C) The Town Department of Public Works shall operate as the Department of Storm Water Management for all storm water purposes, and shall act at all times pursuant to the direction of the Town Storm Water Board.
(D) The President of the Town Council, as the town executive, shall appoint three persons to serve as directors of the Town Storm Water Board, with no more than two of such persons being of the same political party.
(E) The three appointed Directors shall be designated to serve initial terms beginning on January 31, 2012 and ending November 30, 2012, 2013, and 2014 as so designated.
(F) After the initial terms of the Directors are completed, each Director shall thereafter serve a term lasting for a period of six years, so that terms are staggered as provided under I.C. 8-1.5-5-4(d).
(G) The Town Storm Water Board of Directors shall have the powers enumerated in I.C. 8-1.5-5-4(a) and I.C. 8-1.5-5-6.
(H) A special taxing district is hereby established being comprised of the lands within the corporate boundaries of the town (the “District”).
