§ 153.09  DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning. Words used in the present tense shall include the future; words used in the singular number shall include the plural and the plural the singular; words used in the masculine gender shall include the feminine.
   ACCIDENTAL DISCHARGE. A discharge or release prohibited by this chapter which occurs by chance and without planning or thought prior to occurrence.
   ADJACENT PROPERTY OWNERS. The owners of property contiguous to the subject property, excluding those who are also the owners of the subject property, ignoring all intervening streams, street, and railroad rights-of-way.
   APPLICANT. A person or persons submitting an application for development.
   CLEAN WATER ACT. The Federal Water Pollution Control Act (33 U.S.C. §§ 1251 et seq.), and any subsequent amendments thereto.
   CONSTRUCTION ACTIVITY. Land disturbance activities subject to state NPDES general construction permits related to “Rule 13” or “Rule 5” or local permits. Such activities include, but are not limited to, clearing and grubbing, grading, excavating, and demolition.
   CONTIGUOUS. When at least one boundary line of a parcel touches the boundary line of another parcel.
   COUNTY HEALTH DEPARTMENT. The County Health Department.
   GEORGETOWN STORM WATER BOARD. The Board of Directors of the Department of Storm Water Management.
   IDEM. The Indiana Department of Environmental Management.
   IDNR. The Indiana Department of Natural Resources.
   ILLICIT DISCHARGE. Any discharge to a municipal separate storm sewer system (MS4) that is not composed entirely of storm water except discharges pursuant to a national pollutant discharge elimination system permit (other than the town’s NPDES storm water permit) or otherwise defined by this chapter.
   INDOT. The Indiana Department of Transportation.
   INDUSTRIAL ACTIVITY. Activities subject to NPDES industrial permits as defined in 40 C.F.R. § 122.26(b)(14).
   ISDH. The Indiana State Department of Health.
   MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4). Any facility designed or used for collecting and/or conveying storm water, including, but not limited to, any roads with drainage systems, highways, streets, curbs, gutters, inlets, catch basins, piped storm drains, pumping facilities, structural storm water controls, ditches, swales, natural and human-made or altered drainage channels, reservoirs, and other drainage structures, and which is: owned or maintained by the town; not a combined sewer; and not part of a publicly-owned treatment works.
   NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) STORM WATER DISCHARGE PERMIT. A permit issued by the Indiana Department of Environmental Management (IDEM) under delegated authority by the United States Environmental Protection Agency (USEPA), whether the permit is applicable on an individual, group, or general area-wide basis.
   NON-STORM WATER DISCHARGE. Any discharge to the storm drainage system that is not composed entirely of storm water.
   NRCS. The Natural Resources Conservation Service.
   PAVED. A durable surface for parking, driving, riding, or similar activities, that utilizes asphalt, concrete, brick, paving blocks, or similar material. Crushed gravel, stone, rock, dirt, sand, or grass is not permitted as a PAVED surface.
   POLLUTANT. Anything of a chemical component or nature which causes or contributes to pollution.
   POLLUTION. The presence of matter or energy whose nature, location, or quantity produces undesired environmental effects.
   PROPERTY OWNER. Any person who has a legal or equitable interest in the property or his or her authorized representative.
   RESPONSIBLE PARTY. The person causing or permitting a prohibited discharge in violation of this chapter, or the person in control of, or having the right to control, the property or premises from which a prohibited discharge has occurred.
   STANDARD OF PRACTICE FOR RESIDENTIAL CONSTRUCTION STORM WATER MANAGEMENT. A document that defines the management practices for erosion prevention, sediment control, and other construction site waste management by which homebuilders may use as guidance and minimum expectations to be achieved during inspections by the town. In the event that this document is not published, then the Indiana Storm Water Quality Manual or the Indiana Handbook for Erosion and STEEP.
   STORM WATER RUNOFF or STORM WATER. Any surface flow, runoff, and drainage consisting entirely of water from any form of natural precipitation, and resulting from such precipitation.
   STRUCTURAL STORM WATER CONTROL or BEST MANAGEMENT PRACTICE (BMP). A structural storm water management facility or device that controls storm water runoff and changes the characteristics of that runoff including, but not limited to, the quantity and quality, the period of release or the velocity of flow.
   UNDILUTED DISCHARGES. A discharge that has not been mixed with that of another source such as another septic tank.
   WATERS OF THE STATE. Any and all rivers, streams, creeks, branches, lakes, reservoirs, ponds, drainage systems, springs, wells, and other bodies of surface and subsurface water, natural or artificial, lying within or forming a part of the boundaries of the state which are not entirely confined and retained completely upon the property of a single person.
   WETLAND. An area that is inundated or saturated by surface or groundwater at a frequency and duration sufficient to support, and that under normal circumstances does support, a prevalence of vegetation typically adapted for life in saturated soil conditions. (33 C.F.R. § 328.3(b))
