8-2-4: EXEMPTIONS:
The following activities are exempted from the prohibition on open burning:
   (A)   The open burning of leaves, branches and other similar yard debris from October 1 through May 31 of each year between the hours of eight o'clock (8:00) A.M. and four o'clock (4:00) P.M., with the following provisions: Open burning is prohibited during windy days; leaves, branches and yard debris only. No processed materials. Fires must be a safe distance from all structures. A pressurized garden hose must be at the fire site.
   (B)   Barbecues, barbecue pits, and fireplaces, provided that all burning material remains in a non-combustible enclosure and is situated in such manner that fire cannot spread to any structure, tree, or other item or material.
   (C)   Firefighting training under the direction of the Genesee Fire Chief.
   (D)   Weed or fire hazard control under the direction of the Genesee Fire Chief.
   (E)   Buildings, structures, and material deemed a hazard to public safety or health by and under the direction of the Genesee Fire Chief.
   (F)   Any open burn privileges may be revoked by the Mayor, the Genesee Fire Chief or any law enforcement officer at any time prior to its expiration under the following circumstances:
      1.   It is deemed that open burning of materials is being done, or will be done, in a manner that does not comply with the requirements and the provisions of this chapter.
      2.   It is deemed that the open burning of materials is contrary to the public health or safety, or is being done in an unsafe or unreasonably dangerous manner.
      3.   An air quality advisory is issued. (Ord. 411, 7-17-2018)
