10-22-5-7: STANDARDS FOR POSSIBLE BUT UNDETERMINED FLOOD HAZARDS, AS NO ANALYSIS OF FLOOD HAZARDS HAS BEEN CONDUCTED (D ZONE):
   (A)   General Standards:
      1.   All development within a D zone shall be subject to the procedural requirements of this chapter, as applicable; and
      2.   Drainage: Adequate drainage paths around structures on slopes shall be provided in a D zone to guide floodwaters around and away from proposed structures.
      3.   Grading: Any site work in excess of ten (10) cubic yards of cut or fill will require a detailed grading permit. All grading shall be done so as to minimize impacts and maintain compensatory storage within all special flood hazard areas. Depending on the extent and nature of the grading, a LOMC may be required.
      4.   Require that all new subdivision proposals and other proposed developments (including proposals for manufactured home parks and subdivisions) greater than fifty (50) lots or five (5) acres, whichever is the lesser, include within such proposals base flood elevation data. Such Base Flood Elevation (BFE) data shall be adopted by reference in accordance with this chapter and utilized in implementing this chapter. The applicant/developer shall submit an application for a Conditional Letter of Map Revision (CLOMR) prior to Preliminary Plat approval and have obtained a Letter of Map Revision (LOMR) prior to any building permits for structures being issued.

      5.   When Base Flood Elevation (BFE) data is not available from a Federal, State, or other source as outlined above, the lowest floor shall be elevated or floodproofed (non-residential) to two feet (2") above the Highest Adjacent Grade (HAG) at the building site or to the Flood Protection Elevation (FPE) whichever is higher, as defined in this chapter. All other applicable provisions of Sections 10-22-5-1 and 10-22-5-2 shall also apply (STATE RECOMMENDED BUT OPTIONAL). (Ord. 428, 11-1-2022)
