ORDINANCE NO. 2022-04
AN ORDINANCE OF GEM COUNTY, IDAHO, AMENDING THE GEM COUNTY ZONING ORDINANCE TO CHANGE THE DESIGNATION OF CERTAIN REAL PROPERTY LOCATED AT 753 EAST IDAHO BOULEVARD, T06N, R01W, SECTION 5, EMMETT, IN GEM COUNTY, IDAHO.
WHEREAS, CODY THORNOCK, applied to have a certain tract of property as described in Exhibit “A” attached to this Ordinance and made a part thereof, rezoned from A-2 to R-2; and

Legal Description
That portion of Government Lot 8 in the Northwest Quarter of Section 5, Township 6 North, Range 1 West, Boise Meridian, Gem County, Idaho, described as follows:
Commencing at the Northwest corner of Government Lot 8 of Section 5, Township 6 North, Range 1 West, Boise Meridian; thence South 89°23’55” East, 23.70 feet along the North line of said Government Lot 8, to the Northerly prolongation of an existing fence line being the Point of Beginning; thence continuing South 89°23’55” East, 287.77 feet along said North line; thence South 00°26’51” West, 753.00 feet; thence North 89°34’31” West, 291.89 feet along an existing fence line; thence North 00°45’37” East, 753.90 feet along an existing fence line, to the Point of Beginning.
WHEREAS, the Board of County Commissioners of Gem County approved the application with a Development Agreement as stated in its Decision and Order entered on the 6th day of June 2022.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF GEM COUNTY, IDAHO:
1) THAT the land located on 753 East Idaho Boulevard, T06N, R01W, Section 5, Emmett, in Gem County, Idaho, belonging to Cody Thornock, and which is described in Exhibit “A” attached hereto, is hereby rezoned from A-2, Rural Transitional Agriculture, to R-2, Residential Transitional, and the official Zoning Map of Gem County is hereby amended to reflect that change.
2) THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT UPON PASSAGE, APPROVAL, AND PUBLICATION ACCORDING TO LAW
3) REGULARLY PASSED AND ADOPTED by the Board of County Commissioners of Gem County, Idaho, on this 6th day of June, 2022.
