ORDINANCE NO. 2022-02
AN ORDINANCE OF GEM COUNTY, IDAHO, AMENDING THE GEM COUNTY ZONING ORDINANCE TO CHANGE THE DESIGNATION OF CERTAIN REAL PROPERTY LOCATED AT 3800 MILL ROAD, T06N, R01W, SECTION 19, EMMETT, IN GEM COUNTY, IDAHO.
WHEREAS, CARTER AND KATIE YOCHAM, applied to have a certain tract of property as described in Exhibit “A” attached to this Ordinance and made a part thereof, rezoned from A-2 to R-2; and
WHEREAS, the Board of County Commissioners of Gem County approved the application with a Development Agreement as stated in its Decision and Order entered on the ____ day of ________ 2022.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF GEM COUNTY, IDAHO:
1) THAT the land located 3800 Mill Road, T06N, R01W, Section 19, Emmett, in Gem County, Idaho, belonging to Carter and Katie Yocham, and which is described in Exhibit “A” attached hereto, is hereby rezoned from A-2, Rural Transitional Agriculture, to R-2, Residential Transitional, and the official Zoning Map of Gem County is hereby amended to reflect that change.
2) THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT UPON PASSAGE, APPROVAL, AND PUBLICATION ACCORDING TO LAW
3) REGULARLY PASSED AND ADOPTED by the Board of County Commissioners of Gem County, Idaho, on this ____ day of _________________, 2022.

That portion of the West half of the Southwest Quarter of Section 19, Township 6 North, Range 1 West, Boise Meridian, in Gem County, Idaho, more particularly described as follows:
Beginning at the Southwest corner of said Section 19; thence North 0° 03’ 14” East along the West line of said Section 19 a distance of 790.00 feet to the Point of Beginning; thence continuing North 0° 03’ 14” East a distance of 272.00 feet; thence South 89° 17’ 05” East a distance of 860.00 feet; thence South 0° 03’ 14” West a distance of 272.00 feet; thence North 89° 17’ 05” West a distance of 860.00 feet, to the Point of Beginning.
