For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
CHILD. Any person under the age of 18.
DESIGNATED OFFENDER. Any person who has been convicted of a designated sexual offense, regardless of whether adjudication has been withheld, in which the victim of the offense was less than 16 years of age or has been categorized as a Level III sex offender under M.S. § 244.052 or a successor statute.
DESIGNATED SEXUAL OFFENSE. A conviction, commitment under M.S. § 253B, or admission of guilt under oath without adjudication involving any of the following offenses under M.S. §§ 609.342 through 609.345, 609.352, 609.365, 617.247, 617.293; successor statutes; or a similar offense from another jurisdiction.
LICENSED CHILD CARE CENTER. A childcare center that is licensed by Sibley County, Minnesota Public Health and Human Services.
LOITERING. Standing or sitting idly, whether the person is in a vehicle or remaining in or around an area.
PERMANENT RESIDENT. A place where the person abides, lodges, or resides for 14 or more consecutive days.
TEMPORARY RESIDENCE. A place where the person abides, lodges, or resides for a period of 14 days or more days in the aggregate during any calendar year and which is not the person’s permanent address, or a place where the person routinely abides, lodges, or resides for a period of four or more consecutive or non- consecutive days in any month and which is not the person’s permanent residence.
PARK or PLAYGROUND. One of the following:
(1) Any land, including improvements to the land that is administered, operated, or managed for the use of the general public as a recreational area.
(2) Recreational areas include, but are not limited to, conservation areas, jogging trails, hiking trails, biking trails, recreational centers, water parks, swimming pools, skating parks, soccer fields, or baseball/softball fields.
PLACES WHERE CHILDREN REGULARLY CONGREGATE. Includes public parks, private and public schools, licensed daycare facilities, public libraries, amusement parks and centers, recreation centers, youth athletic fields, public or commercial and semi- private swimming pools, and specialized schools for children, including but not limited to gymnastic and dance academies.
