§ 153.210  POWERS AND DUTIES.
   (A)   The Board of Adjustment is hereby established as the City Council and vested with the authority as is hereafter provided and as provided by the state statutes.
   (B)   The Board of Adjustment shall have the following powers:
      (1)   To grant variances, that is, to vary or modify the strict application of any of the regulations or provisions contained in this chapter in cases in which there are practical difficulties or unnecessary hardships in the way of the strict applications. No variance or modification of the uses permitted within a District shall be allowed, except as an official amendment to this chapter;
      (2)   To hear and determine appeals as to the exact boundaries of zoning districts;
      (3)   To interpret the Zoning Code;
      (4)   To hear and decide appeals from and review any order, requirement, decision or determination made by an administrative official charged with enforcing this chapter; and
      (5)   Any decision by the Board of Adjustment shall be final, however, any person having an interest affected by the decision shall have the right to appeal to the District Court.
