191.04 WAIVABLE OFFENSES; SCHEDULE.
   (a)   Waivable offenses shall be administered by the Mayor’s Court Violations Bureau and shall include the following offenses and fines therefor, which include all administrative costs, and they shall be published in accordance with Rule 13 of the Ohio Traffic Rules.
 
      (1)   Violations associated with accidents where there is no injury to persons:
         Reasonable control               $200.00
         Failure to yield               $200.00
         Assured clear distance            $200.00
         Any other violations associated with an
            accident and no injuries to persons      $200.00
      (2)   Moving violations:
         Speed (1 to 19 mph over limit)         $190.00
         Speed (20 to 29 mph over limit)         $200.00
         Red light violation               $180.00
         Prohibited right on red            $180.00
         Improper uses lanes/lines            $180.00
         Weaving/Failure to give full time attention      $180.00
         Any other moving violation not listed      $180.00
      (3)   Non-Moving Violations:
         Expired operator’s license            $180.00
         License plate violations            $180.00
         Equipment violations               $180.00
         Any other non-moving violations         $180.00
      (4)   Seat belt violations:
         Driver                     $91.00
         Passenger                  $81.00
         Child restraint                  $91.00

   (b)   The following offenses are not waiverable and require an appearance in Lyndhurst Municipal Court:
      (1)   Indictable offenses;      
      (2)   Operating a motor vehicle while under the influence of alcohol or any drug of abuse;
      (3)   Leaving the scene of an accident;
      (4)   Driving while under suspension or revocation of a driver’s or commercial driver’s license;
      (5)   Driving without being licensed to drive;
      (6)   A third moving traffic offense within a twelve-month period;
      (7)   Failure to stop and remain standing upon meeting or overtaking a school bus stopped on a highway for the purpose of receiving or discharging a school child;
      (8)   Willfully eluding or fleeing a police officer;
      (9)   Drag racing;
      (10)   Any accident involving an injury; and
      (11)   Speed in excess of 30 mph over the limit/reckless operation.
