1175.05 CHANGES TO LAND; PERMIT REQUIRED.
   (a)   If any owner, developer, builder or occupant intends to make changes to any land within the Protected Hillside Zone proposed to be subdivided, split, developed or altered by any earth-disturbing activity, or by grubbing, grading or excavating, or by the removal or destruction of any natural vegetation and its topsoil, a tree or trees or other vegetative covering thereon, the same shall only be accomplished after the owner, developer, builder or occupant of land within the Protected Hillside Zone, as defined in Section 1175.04, has first obtained a permit from the Building Official authorizing such activity in the Protected Hillside Zone.

   (b)   No permit shall be required for minimal property maintenance activities, including normal landscaping, gardening, maintenance or routine arboreal activities, or small scale planting of ornamental flowers or shrubs, or removal of diseased, dead or damaged trees or trees which are a threat to the health and safety of the community, or replacement of an existing septic system if no other construction or earth-disturbing activity is associated with the replacement of the system. However, such activities shall be carried out in conformity with the standards of vegetation or revegetation set forth in this chapter. (Ord. 2508. Passed 9-8-92.)
