§ 32.40 EMPLOYEES TESTING POSITIVE.
   Employees who test positive may be subject to immediate discipline up to and including discharge but, subject to the following terms and conditions, may be allowed to continue employment on a probational basis:
   (A)   A recommendation of continued employment by a department head of the city department to which the employee is assigned;
   (B)   The employee agrees to participate in counseling in a certified rehabilitation program and successfully completes the program and all the requirements thereof;
   (C)   The employee remains drug and alcohol free during the probationary employment period;
   (D)   The employee agrees to routine periodic unscheduled drug and alcohol screen test to ensure that the employee remains drug and alcohol free, which routine or unscheduled test may continue for a period of up to 60 months; and
   (E)   The probationary period of employment may continue as determined by the Board of Works for a period of up to one year following the report of drug and alcohol test.
