§ 32.36 RULES OF CONDUCT.
   All employees of the city shall follow the following rules.
   (A)   All city employees who are referred to undergo testing procedures herein are required to do so, and the refusal to undertake such testing procedures may result in immediate discharge.
   (B)   The off-duty abuse of alcohol or illegal use of controlled substances which results in or is a factor in excessive absenteeism, tardiness, poor workmanship or performance of duty, or is a factor in an accident, may subject the employee to a mandatory assistance program for rehabilitation, and should such an employee so referred reject such reference or fail to fully participate in and fulfill all the requirements thereof, such employee may be subject to discharge.
   (C)   As a condition of employment, all employees of the city will abide by the terms of this subchapter and will notify his or her immediate supervisor of any conviction or a violation of any statute or ordinance, whether felony, misdemeanor, or infraction relating to any alcohol or controlled substance, whether or not such conduct occurs during work hours or in the performance of a duty on behalf of the city. Such notification must occur not more than five days after any such conviction.
