§ 155.35 STATE PROVISIONS ADOPTED BY REFERENCE.
   The provisions of I.C. 36-9-28.7-1 et seq., concerning storm water nuisances are hereby adopted in their entirety and are incorporated by reference herein. STORM WATER NUISANCE shall mean a condition:
   (A)   Arises out of or is related to storm water that is transferred through runoff or an artificial conveyance that:
      (1)   Is directed to the property of another person;
      (2)   Discharges storm water at or near the property line of another person; or
      (3)   Accelerates or increases the flow of storm water onto another person’s property.
   (B)   To which one or both of the following apply.
      (1)   The condition is injurious to health.
      (2)   The condition substantially obstructs the free use of property.
