§ 111.17 DEFINITIONS.
   For the purpose of this subchapter, the following definitions apply unless the context clearly indicates or requires a different meaning.
   BARS and TAVERNS. An establishment that meets the following conditions:
      (1)   Holds one or more of the following licenses:
         (a)   A beer retailer’s permit under I.C. 7.1-3-4;
         (b)   A liquor retailer’s permit under I.C. 7.1-3-9; or
         (c)   A wine retailer’s permit under I.C. 7.1-3-14.
      (2)   Does not employ an individual who is less than 18 years of age; and
      (3)   Does not allow individuals less than 21 years of age to enter.
   CLUBS. An association or corporation that:
      (1)   Organized under the authority of law;
      (2)   Been in active, continuous existence for at least three years;
      (3)   Maintained a membership roll for a three-year period;
      (4)   Shall have a paid-up membership of more than 50 members;
      (5)   Shall be the owner, lessee, or occupant of an establishment operated solely for objects of a national, social, patriotic, political, or athletic nature, or the like;
      (6)   Shall not be operated for financial gain;
      (7)   The property and advantages belong to its members; and
      (8)   It shall maintain an establishment provided with special space and accommodations where, in consideration of payment, food, with or without lodging, is habitually served.
   E-CIGS or E-CIGARETTES. Other terms used to refer to ELECTRONIC CIGARETTES.
   ELECTRONIC CIGARETTE. A device that is capable of providing an inhalable dose of nicotine or any other substance intended for human consumption by delivering a vaporized solution that can be used by a person to simulate smoking through inhalation of vapor or aerosol from the device. The term includes the components and cartridges.
   ELECTRONIC WATER PIPE. A device that is capable of providing an inhalable dose of nicotine or any other substance through water intended for human consumption by delivering a vaporized solution that can be used by a person to simulate smoking through inhalation of vapor or aerosol from the device.
   E-LIQUID. A substance that:
      (1)   May or may not contain nicotine; and
      (2)   Is intended to be vaporized and inhaled using a vapor product.
   FRATERNAL CLUBS; LABOR ORGANIZATIONS.
      (1)   An association or corporation whose membership is comprised of or forms:
         (a)   A lodge or local chapter or corresponding unit of a fraternal order of another association of a like nature, or a body whose membership is comprised of persons who have served in the armed forces of the United States; and/or
         (b)   Has been in continual existence on a national scale for more than five years.
      (2)   FRATERNAL CLUBS and LABOR ORGANIZATIONS need not meet the requirements of the definition of CLUBS, but are considered CLUBS for all other purposes.
   VAPING. The process of inhalation or exhalation of the electronic cigarette, e-cigs, electronic water pipe, and vaporizers.
   VAPORIZER. A device like an electronic cigarette that is used to inhale the e-liquid.
   VAPOR PRODUCT. A powered vaporizer that converts e-liquid to a vapor intended for inhalation through an electronic cigarette or an electric water pipe.
