§ 130.01 CURFEW FOR MINORS.
   (A)   Hours for minors under 16. No minor under the age of 16 years of age shall be or remain in or upon any public street, alley, park, playground, public building, public place of amusement and entertainment, vacant lot, or unsupervised public place between the hours of 10:00 p.m. and 5:00 a.m. the following day.
   (B)   Hours for minors under 18. No person under the age of 18 years shall be or remain in or upon the public streets, alleys, parks, playgrounds, public grounds, public places, public buildings, public places of amusement and entertainment, vacant lots, or other unsupervised public places within the city between the hours of 11:00 p.m. and 6:00 a.m. of the following day, unless accompanied by his or her parent, guardian, or other adult person having the care and custody of the person, or where the person is upon an emergency errand or legitimate business directed or authorized by his or her parent, guardian, or such other adult person having the care and custody of the person.
   (C)   Exceptions and penalties. The provisions of divisions (A) and (B) above shall not apply to:
      (1)   Any minor accompanied by his or her parent, guardian, or other adult person having the care and custody of the minor or where the minor is upon an emergency errand or legitimate business directed or authorized by his or her parent, guardian, or such other adult person having the care and custody of the minor;
      (2)   Any minor within the half hour following the formal dismissal time of any service or authorized activity of any church, school, club, or other adult-sponsored organization, provided said minor shall have actually attended said service or authorized activity; or
      (3)   Any minor within the half hour following the minor’s being released from employment.
   (D)   Violations. Any minor violating the provisions of divisions (A) and (B) above shall be dealt with in accordance with juvenile court law and procedures.
   (E)   Responsibility of officers. It shall be the right of any authorized officer to arrest and detain any person violating the curfew and to keep the person detained until the parent, guardian, or custodian is notified, when the person may be released upon the giving of a promise by the person and his or her parent, guardian, or custodian that such person together with his or her parent, guardian, or custodian will appear at a stated time before the proper authority to answer to the charges.
   (F)   Responsibility of parents or guardians. It shall be unlawful for the parents, guardians, or other adult persons having the care and custody of a person under the age of 18 years to knowingly permit such a person to be or remain in or upon the public streets, alleys, parks, playgrounds, public grounds, public places, public buildings, public places of amusement and entertainment, vacant lots, or other unsupervised public places within the city between the hours of 11:00 p.m. and 6:00 a.m. of the following day, except when the person is accompanied by his or her parent, guardian, or other adult person having the care and custody of the person, or when the person is upon an emergency errand or legitimate business directed or authorized by his or her parent, guardian, or other adult person having the care and custody of the person.
