(A) Any person in violation of this chapter is subject to the general penalty provision listed in § 10.99.
(B) In addition to the penalties provided for § 10.99, any person and/or business entity violating the provision of this chapter may be enjoined from continuing the violation. Notwithstanding the previous sentence, any violation of this chapter by any business licensed under SDCL Title 35, shall, following a hearing as required by SDCL § 35-2-11.1, result in a mandatory recommendation to the State Secretary of Revenue that such business’ license by suspended or revoked for such violation. In the event that the hearing requirement of SDCL § 35-2-11.1 is waived or otherwise suspended pursuant to gubernatorial action pursuant to SDCL § 34-48-5, then such recommendation will be made without a hearing. Each day a violation of this chapter is allowed to occur is considered a separate offense.
