§ 95.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   (1)   Any person who creates, commits, maintains, or fails to abate a public nuisance as required under the provisions of §§ 95.01 through 95.06, 95.22(C) and 95.23 shall be subject to a maximum penalty or 30 days in jail or $200 fine, or both. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues. In addition, the city may also use the remedies of civil action and abatement as set forth in SDCL §§ 21-10-5 through 21-10-9.
      (2)   If the property owner does not mow his, her, or their property within a week of being informed that their property needs mowing, the city will mow the property and charge the property owner by the prices stated in § 95.21.
      (3)   Any person violating any of the provisions of § 95.22(B), upon conviction thereof, be fined in a sum not to exceed $25 for each offense.
