§ 94.31 SALE OF FIREWORKS.
   (A)   It shall be lawful for an individual, firm, partnership, or corporation to sell or possess for sale any pyrotechnics (commonly known as fireworks) within the city limits in and along Highway 11, as set forth in SDCL § 34-37-10 to wit: Period and times during which retail sales permitted. No person, firm, or corporation may offer fireworks for sale to individuals at retail except during the period beginning June 27 and extending through July 5, and during the period beginning December 28 and extending through January 1.
   (B)   Application for such sales shall be presented to the City Council, provided approval has been granted by land owner for said location of fireworks concession and all applicable state and city sales tax will be submitted to the state’s Department of Revenue.

§ 94.99 PENALTY.
   (A)   Any persons violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   (1)   Any person or persons violating any of the provisions of § 94.16(A) shall be guilty of petty offense and shall be fined a sum not to exceed $100 or 30 days jail, or both.
      (2)   Any person, firm, or corporation found guilty of violation of §§ 94.16(B) through 94.16(D) shall be fined not less than $5, nor more than $25 for each offense.
   (C)   Any person who shall violate any of the provisions of § 94.30 shall be deemed guilty of a misdemeanor and shall be fined in a sum of not less than $10, nor more than $100 for each and every offense.
