ORDINANCE NO. 0-22-09
AN ORDINANCE AMENDING GARLAND MUNICIPAL ORDINANCE CODE CONCERNING CHANGES TO THE AGRICULTURAL ZONE USES AND AREA MODIFICATIONS APPLICABLE TO AGRICULTURAL ZONES OF GARLAND CITY; PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE.
 
WHEREAS, Garland City (hereafter “City”) is a municipal corporation, duly organized and existing under the laws of the State of Utah; and
 
WHEREAS, Utah Code empowers municipalities of the state to enact all ordinances and rules that they consider necessary of operations within the municipality; and
 
WHEREAS, the City finds it is in the best interest of the community and its citizens to sometimes update and clarify sections of the City Code in order to better inform and protect the general public; and
 
WHEREAS, a public hearing was held, and notice thereof published in accordance with Utah State Law, describing the proposed addition and providing the time and place of such public hearing; and
 
WHEREAS, the Garland City Council received all competent evidence offered in support of and in opposition to said proposed amendment(s) in said meeting and it appearing that the proposed amendment(s) are in accord with the City's goals and will promote health, safety, and the general welfare of the community.
 
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF GARLAND, UTAH, AS FOLLOWS:
 
Section 1. That Garland City Code be amended and shall now read as follows:
 
CHAPTER 6 AGRICULTURAL ONE A1 SECTION:
: Use Regulations
: Area, Width, Yard, And Height Regulations
 
: USE REGULATIONS:
In Agricultural Zone, A1, no building or structure or land shall be used and no building or structure shall be erected which is arranged, intended, or designed to be used for other than one or more of the following uses:
Any use permitted in residential zone R3.
Raising and grazing of horses, cattle, sheep, rabbits, or goats; provided, that such raising grazing is not a part of, nor conducted in conjunction with, any livestock feed yard, slaughterhouse, animal byproducts business, or commercial riding academy.
The minimum lot area for raising or grazing horses, cattle, sheep, rabbits, or goats shall be o ne acre. A maximum of two (2) horses; or two (2) cattle; or four (4) sheep, goats; or
t wenty (20) rabbits per acre.
Accessory uses and buildings customarily incidental to the above. (Ord., 9-3-1996, Amd. O-22-09 )
 
AND
 
: AREA, WIDTH, YARD, AND HEIGHT REGULATIONS:
Area: The minimum lot area for any dwelling shall not be less than  ten  forty-three thousand five hundred sixty (10,000  43,560) square feet. 
Width: The minimum width of any lot which is required by this chapter to contain a minimum of ten thousand (10,000) square feet shall be sixty-five feet (65'); the minimum width of any lot which is required by this chapter to contain a minimum area of one acre shall be one hundred thirty-two feet (100 132'). 
Side Yard: Same as residential zone R3 for dwelling and accessory buildings. For all other buildings, the minimum side yard shall be eight feet (8') and the total width of the two (2) required side yards shall be not less than sixteen feet (16').
Front And Rear Yard: Same as for residential zone R1.
Height: Same as for residential zone R1. (Ord., 9-3-1996)
Maximum Lot Coverage: Twenty-five percent (25%) of the entire lot area. (Amd. O-22-09_
 
Section 2. Repealer. Any provision of the Garland Municipal Code found to be in conflict with this ordinance is hereby repealed.
 
Section 3. Severability. If any provision of this ordinance is declared invalid by a court of competent jurisdiction, the remainder shall not be affected thereby.
 
Section 4. All other terms, provisions, and conditions as previously adopted remain in full force and effect unless specifically amended hereby.
 
Section 5. This ordinance shall take effect immediately upon its adoption, posting and appropriate signage being placed.
