1-9-13: APPEALS:
   A.   Any actual or prospective bidder or contractor who is aggrieved in connection with the solicitation or award of a contract may appeal to the purchasing officer. An appeal shall be submitted in writing within five (5) working days after the contract to which the grievance relates is awarded. No appeal may be taken in connection with purchases involving less than three thousand dollars ($3,000.00) nor in the event all bids are rejected by the city.
   B.   The purchasing officer shall promptly issue a written decision regarding any appeal, if it is not settled by a mutual agreement. The decision shall state the reasons for the action taken and inform the bidder, contractor, or prospective contractor of the right to appeal to the governing body, in writing, within five (5) working days from the date the decision is issued.
   C.   The city council's decision shall be final. (Ord. 10-10, 11-18-2010)
