10-3-1: IMPROVEMENTS REQUIRED:
   A.   No final plat of a subdivision of land shall be recorded without receiving a statement signed by the city engineer certifying that the improvements described in the subdivider's plans and specifications meet the minimum requirements of all ordinances of the city, that they comply with the recommendations of the local and/or state board of health, the planning and zoning commission, the fire and other city departments and with the standards, rules and regulations for subdivisions approved by the governing body, which standards, rules and regulations are hereby incorporated in this title by reference.
   B.   No final plat of a subdivision of land shall be recorded unless the subdivider shall furnish to the city a guarantee in an amount equal to one hundred fifteen percent (115%) of the reasonable cost of the improvements required by this chapter. The amount of the guarantee shall be estimated by the subdivider's engineer and approved by the city engineer, and conditioned upon payment by the subdivider of all expenses incurred and for all labor or material used in the construction of required improvements. The provisions of the guarantee shall be for the protection of laborers and materialmen and to guarantee the quality, quantity and performance of all improvements as required herein. In no event shall the city be deemed liable under this chapter on any claim asserted by a laborer or materialman. (Ord., 2-29-1996)
