§ 52.03 REGULATIONS.
   (A)   John’s and Emery Valley. Underground wastewater disposal systems within the John's and Emery Valley boundary shall meet the minimum standards:
      (1)   Minimum lot size for new subdivision applications submitted after adoption of this chapter by the Board of Garfield County Commissioners:
         (a)   Commercial developments: 10 acres.
         (b)   Residential developments: 6 acres.
         (c)   Developments with shared or offsite wastewater systems approved by the local health department or the State of Utah Department of Environmental Quality (DEQ) shall meet the minimum lot or parcel area requirements of the Garfield County Zoning Ordinance.
      (2)   Maximum Total Inorganic Nitrogen (TIN) treatment level shall be 2.5 m/L certified by an engineer licensed in the State of Utah and a construction permit shall be authorized by the local health department or State of Utah DEQ for the proposed system before issuance of any associated building permits.
         (a)   Treatment levels may be achieved by the underground wastewater disposal system effluent, lot or parcel size or any combination thereof.
      (3)   If the minimum standards outlined in this section for underground wastewater disposal systems cannot be met, a different wastewater disposal system shall be required, or the development shall be terminated.
   (B)   Panguitch Lake. Underground wastewater disposal systems within the Panguitch Lake boundary shall meet the minimum standards:
      (1)   Minimum lot or parcel size:
         (a)   Public/shared drinking water system: 0.5 acres.
         (b)   Onsite drinking water system: 1.0 acres.
      (2)   Maximum Total Inorganic Nitrogen (TIN) treatment level shall be 30 m/L certified by an engineer licensed in the State of Utah and a construction permit shall be authorized by the local health department or State of Utah DEQ for the proposed system before issuance of any associated building permits.
      (3)   If the minimum standards outlined in this section for underground wastewater disposal systems cannot be met, a different wastewater disposal system shall be required, or the development shall be terminated.
   (C)   Sevier River and Mammoth Creek Subdivisions. Underground wastewater disposal systems within the Sevier River boundary shall meet the minimum standards:
      (1)   Due to the small lot sizes, evident wetlands and proximity to the waters of the state, this section shall apply to the following subdivisions:
         (a)   Sevier River.
            1.   Hidden River Estates.
            2.   The Hercules Subdivision.
            3.   Sevier River Estates.
            4.   Upper Sevier Subdivision.
         (b)   Mammoth Creek.
            1.   Mammoth Creek Community.
            2.   Bonanza Estates.
      (2)   Minimum lot size:
         (a)   Public/shared drinking water system: 0.5 acres.
         (b)   Onsite drinking water system: 1.0 acres.
      (3)   Maximum Total Inorganic Nitrogen (TIN) treatment level shall be 30 m/L certified by an engineer licensed in the State of Utah and a construction permit shall be authorized by the local health department or State of Utah DEQ for the proposed system before issuance of any associated building permits.
      (4)   If the minimum standards outlined in this section for underground wastewater disposal systems cannot be met, a different wastewater disposal system shall be required, or the development shall be terminated.
   (D)   Other unincorporated areas of Garfield County. Underground wastewater disposal systems located within all other unincorporated areas of Garfield County shall meet the minimum standards of Garfield County, the local health department and/or the State of Utah DEQ.
