§ 90.40 NO TRESPASS WITHOUT A FENCE.
   Except as hereinafter provided, no person, firm, or corporation shall be entitled to collect damages, and no court in this state shall award damages for any trespass of livestock on farms, subdivisions, or other private property, or land belonging to the United States of America or the state, and used for grazing purposes in the county, if such land at the time of such trespass shall not have been enclosed by a legal fence properly maintained, unless said damaged owner had offered to share the cost of a fence with the owner of whose livestock has trespassed, and the latter has refused to participate in the cost of said fence.
