(A) Subject to the limitations of division (B) below, this subchapter shall apply to vehicle/livestock collisions in open range areas in the county. For the purposes of this subchapter, OPEN RANGE AREAS shall be classified as: public and/or private lands within the unincorporated areas of the county without fencing, where livestock may roam freely and drift onto any road moving to or from their accustomed ranges.
(B) This subchapter shall not apply to any motor vehicle/livestock collision that occurs in:
(1) Incorporated areas in the county;
(2) Unincorporated areas in the county that do not fit the definition of open range areas under division (A) above; or
(3) Unincorporated areas of the county that do fit the definition of open range areas under division (A) above, but where a motor vehicle/livestock collision involved livestock that escaped an enclosure.
