In any zoning district, wind-driven energy devices, as accessory uses, may be allowed subject to the following conditions.
(A) The setback shall be equal to the height of its highest point in the vertical axis. The City Council may grant a reduction in the setback when it finds that the reduction shall not adversely affect surrounding property, and is consistent with the intent of this title to promote the public health, safety and general welfare.
(B) The operation shall not cause interference to the radio and television reception on adjoining property.
(C) To limit climbing access to the tower, a six-foot fence made of opaque material with a locking portal shall be placed around the tower base, or the tower climbing apparatus shall be limited to no lower than 12 feet from the ground, or the tower may be mounted on a roof top.
(D) Data pertaining to the machine's safety and stability shall be filed with the application for building permit and shall meet final approval of the Building Inspector.
(E) The applicant shall submit covenants, easements, or similar documentation from abutting owners providing access to wind sufficient for its adequate operation, unless accessibility to the wind is furnished on the site.
(F) The wind-driven energy devices, if interconnected to a utility system, shall meet the requirements for interconnection and operation as set forth in the electric utility's current service regulations applicable to wind-driven energy devices.
(G) The wind-driven energy device shall be located a sufficient distance from any overhead utility lines, excluding service drops, such that a structural failure of any portion of the wind-driven energy device or its supporting structure would not cause any portion of it to fall within five feet of the lines.
(H) The operation of the wind-driven energy device in an average 20 m.p.h. wind shall produce no more than the following decibel (db) readings at the closest point of contact of any adjoining property line.
