(A) No person shall occupy any street with any materials or machinery incidental to the construction or repair of any building adjacent to the street or for any other purpose without first obtaining a written permit and filing a bond of not less than $3,000. (‘83 Code, § 94.14)
(B) At least five feet of sidewalk space shall be kept clear and clean for the free passage of pedestrians. If the building operations are such that free passageway is impracticable, a temporary plank sidewalk with a substantial railing on each side, built to the specifications of the Director or designated representative, shall be provided around the obstruction. (C) All openings, excavations, and obstructions shall be properly and substantially barricaded and railed off, and at night shall be provided with approved warning lights. Warning lights shall comply with the Michigan Manual of Uniform Traffic Control Devices. (‘83 Code, § 94.16)
(D) Encroachments and obstructions in the street may be removed and excavations refilled and the expense of removal or refilling charged to the abutting land owner when made or permitted by him or suffered to remain by him, otherwise than in accordance with the terms and conditions of this chapter. The procedure for collection of expenses shall be as prescribed in the Charter for single lot assessments upon not less than seven days notice to the land owner in accordance with § 10.09 of this Code. (E) All building operations shall be conducted in a safe and careful manner, with due regard to the safety of the public. The following provisions shall be complied with.
(1) Whenever any building or part thereof is to be erected, added to, or demolished, and any enclosing wall of the building is within ten feet of the street line, and the foregoing operations are not carried on entirely within the enclosing walls of the building, a substantial fence not less than six feet in height shall be maintained on the building side of the walkway, and a substantial roof of not less than eight feet in clear height above the walkway shall be maintained over the walkway, except that when the building is less than 40 feet in height and no enclosing wall of which is within seven feet of any walkway, the walkway need not be roofed over.
(2) Guard lights shall be displayed during the legal hours of darkness on all obstructions and around all dangerous excavations within the public right-of-way.
(3) In demolishing any building or part thereof, the upper story shall be completely removed before starting the removal of the story below. No material shall be stored upon any floor of a building in a course of demolishing, and all material shall be lowered to the ground immediately upon displacement. Materials which, in their removal, cause an excessive amount of dust, shall be wet down.
(4) No building material, fence, shed, or obstruction of any kind shall be placed so as to obstruct free approach to any fire hydrant, lamppost, manhole, fire alarm box, catch basin or inlet, or be placed so as to interfere with drainage.
