§ 54.03 RECEPTACLES.
   (A)   It shall be the duty of owners, proprietors, or persons in charge of every dwelling, house, store, manufacturing establishment, office building, or other building in the city to place or cause to be placed all refuse accumulating on the premises in suitable containers or receptacles provided by the owner or other person. All garbage or rubbish placed outside of buildings, whether it be on public or private property, shall be placed in secured plastic bags or suitable covered containers, size to be determined by the Director.
   (B)   All garbage and rubbish shall be secured in plastic bags or water-tight containers, tapered in such a manner as to be larger in diameter at the top than at the bottom, with covers sufficiently tight- fitting to keep out water and to prevent disturbance by animals and the entrance of insects. All garbage and rubbish receptacles that have not been provided by the city shall be not less than five nor more than 32 gallons in capacity. All garbage and rubbish containers shall be equipped with handles by which they may be lifted. The combined weight of any refuse container and its contents shall not exceed 50 pounds. The containers shall not be so small as to require an excessive number of containers for each household.
   (C)   All bulk refuse accumulated in residential, commercial, or manufacturing buildings, such as cardboard containers, wood crates, and similar refuse, shall be flattened and tied in bundles or packed in suitable containers of a size that may be readily handled by one collector, and in no case shall any bundle or container be larger than three by three by four feet. Brush and tree limbs shall be cut into lengths not exceeding four feet and tied into bundles which can be readily handled by an individual collector. Tree limbs exceeding four inches in diameter will not be collected by the city.
   (D)   (1)   Yard waste will be picked up April 1 through December 15 and cannot be mixed with garbage or rubbish at any time. Christmas tree pickup begins the day after Christmas and through January 15.
      (2)   During the yard waste collection period, the following containers for curbside yard waste collection shall be required:
         (a)   A 32-gallon refuse container with a “yard waste” recycling sticker provided by the Department of Public Services; or
         (b)   Kraft-type brown paper bag specifically designed for yard waste.
      (3)   Marked cans and bags should be placed at the curb for pickup on the same day as regular refuse collection. Yard waste placed in improper containers or mixed with regular refuse will not be collected. When set out for collection, yard waste shall be separated from regular refuse approximately five feet.
   (E)   Any person who violates this section shall be responsible for a municipal civil infraction and subject to the civil fines set forth in § 41.06.
