§ 36.37 DISABILITY RETIRANT; DEATH.
   (A)   A disability retirant shall be given service credit for any period he is in receipt of workmen's compensation benefits on account of a disability arising out of and in the course of his employment by the city. Upon termination of workmen's compensation benefits, the retirant's disability pension shall be recomputed to include the additional service credit. During the period a retirant is receiving a disability pension, his contributions to the pension savings fund shall be suspended. (‘83 Code, § 36.38)
   (B)   In the event a disability retirant dies before he has received pension payments aggregating an amount equal to his accumulated contributions to his credit in the pension savings fund at the time of his retirement, the difference between the accumulated contributions and the aggregate amount of pension payments shall be paid from the pension accumulation fund to the person or persons as he shall have nominated by written designation duly executed and filed with the Board. If there is no designated person or persons surviving the retirant, then the difference, if any, shall be paid to his legal representative. No benefits shall be paid under this section on account of the death of a retirant if he elected Option (A) or (B) provided for in § 36.19(B). (‘83 Code, § 36.39)
